P3 Project: Municipal Water Treatment Facility (2016)

Local counsel for the financer, design-builder and also Spanish operator for the financing and design-build of new municipal water treatment facility and a 30 year operations and maintenance agreement for an upgraded system. Project valued in excess of $200-million.

Advised on all aspects of contract review (originally drafted under Ontario law) to ensure compliance with provincial law in local jurisdiction. Also provided an opinion to all parties on behalf of the financer, design-builder and O&M party. Effective coordination, including collaborating with lawyers representing other parties and delivery of opinions, proved successful in helping to turn the project over to a P3 model, credited for being a more economical approach to ensure that safe, clean drinking water remains a top priority for city council.
