McInnes Cooper was successful in acting for the Respondent in an appeal brought forward by the Canadian Association for Free Expression. In the appeal decision Justice Deschênes, Justice Quigg and Justice Green agreed with the application judge’s original decision to invalidate a residual bequest from the Estate of Harry Robert McCorkill to the beneficiary, National Alliance, on the basis that the activities and communications of the beneficiary are illegal and contrary to public policy of Canada and New Brunswick. The appeal was dismissed with costs awarded to the respondents.
