Gurung v Trampleasure, 2020 BCSC 1643
On November 4, 2020, Justice Ross of the British Columbia Supreme Court awarded damages in the amount of $514,125 to the Plaintiff, Ms. Gurung.
The Plaintiff was involved in a motor vehicle accident in 2015. As a result of the accident she suffered from headaches, Post Traumatic Stress Disorder, depressive episodes, generalized anxiety disorder, and chronic pain in the neck and right shoulder. The Court assessed non-pecuniary damages at $130,000.
At the time of the accident Ms. Gurung was working as a bedside nurse. Following the accident she was unable to work for two years, then returned to work in an administrative role. The Court awarded $213,631 in past wage loss, and $100,000 for future loss of earning capacity.
